INFORMATION of the Intellectual Property Agency on the presentation of the folk song "Kuchelere su sepmishem" as a Persian song on YouTube

Recently, the country's media and social networks reported that the Azerbaijani folk song "Kuchelere su sepmishem" was broadcast on YouTube as a Persian song.

The Intellectual Property Agency immediately took control of the matter and an appropriate investigation was conducted.

It was determined that on several YouTube channels including chekhabar1234 and Persian Song, the song named “Dooset daram” performed by Iranian musician fereydoun Asraei, has been uploaded without any reference stating that this song is an Azerbaijani folk song.

In this regard, we note that the music of the song is the music of the Azerbaijani folk song "Kuchelere su sepmishem". The lyrics of the song have been changed and the origin of the music has not been indicated. Such misappropriation of the music of the song and its indirect presentation as Persian music is a gross infringement of intellectual property rights. Namely it contradicts the provisions of the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty.

There is a lot of evidence that the song belongs to the cultural heritage of the Azerbaijani nation. 2.The Azerbaijani folk song “Kuchelere su sepmishem” (“I sprinkled water on the streets”) has been included in a number of collections of Azerbaijani folk songs since the early XX century. For example, “Azerbaijani folk songs” by the famous Azerbaijani composers Uzeyir Hajibeyov and Muslim Magomayev, published in 1927, -“Azerbaijan Folk Melodies” by Bulbul Mammadov, published in 1956 (Volume I – Said Rustamov), -“Azerbaijani Folk Songs” by the famous Azerbaijani composer Fikret Amirov, published in 1952, -“Azerbaijan Lyrical Folk Songs” published by Davud Mammadbayov in 1965, -The notes and lyrics of the song “Kuchelere su sepmishem” (“I sprinkled water on the streets”) were published in Salih Turhan’s book “Azerbaijani folk songs”, in Ankara, Turkey in 1991.

The song was also performed in the 1954 film "To My Native People".

3.Based on the application of the famous Azerbaijani composer Fikret Amirov dated June 12, 1963, a revised version of the folk song “Kuchelere su sepmishem” (“I sprinkled water on the streets”) was included in the catalogue and registered in the Azerbaijan branch of the Soviet Copyright Agency (currently Intellectual Property Agency of Azerbaijan). A reworked version of the song, performed by Azerbaijani singer Rashid Behbudov in 1963, has been uploaded to YouTube.

4.The folk song “Kuchelere su sepmishem” (“I sprinkled water on the streets”) was also performed and recorded on video by famous Azerbaijani singers Bulbul, Shovkat Alakbarova and others, and also uploaded to the YouTube.

We would like to emphasize that the folk song “Kuchelere su sepmishem”(“I sprinkled water on the streets”) was performed by Iranian musician Fereydoun Asraei in Azerbaijani and Persian Languages and was included into the album “Khuneh be Dush” under the name “Dustat daram” (track number 8), which is available on www.amazon.com and most importantly it has been marked as an example of Azerbaijani folklore (by Azeri Folk).

Based on the facts and sources listed by the Agency, a detailed appeal covering the results of the investigation has been prepared and addressed to the relevant section of the Youtube portal asking to add the information on the original name and the origin of the Azerbaijani folk song “Kuchelere su sepmishem” to the chekhabar1234 and Persian Song pages or otherwise to shut down theose channels.
