​Registration of copyright remains as a fundamental confirmation of the rights to the work

It was once again confirmed by the court's decision in the Ulyanovsk city of Russian Federation. The photographer was shocked by the court's decision who appealed to one of the regional courts of the city to approve copyright for his photographic work. The court denied the claim, noting that the photographer did not bring substantiated evidence confirming his authorship, also noting that the photographer did not register the author's work properly.

Although in Russia the registration of the work is voluntary just like in Azerbaijan, and protection of the work does not require any compulsory formalization, the practice of judicial practice shows that in most cases the registration of copyright in the relevant body ends with the recognition of the party who did this, by the court as the author.

The legislation of the Republic of Azerbaijan recognizes the certificate on registration of work as the author's presumption. That is, when another person claims to be the author of that work, he must present substantiated evidences in order to prove that claim. Otherwise, the person who registered the work is considered as the author.
