An employee of the Intellectual Property Agency participated in the WIPO Webinar for Judges

On January 22, 2025, a World Intellectual Property Organization webinar for Judges entitled "Digital Evidence in Trademark Cases" was held. The webinar is dedicated to the growing role of digital evidence in trademark disputes. The key issues related to the reliability of digital evidence, as well as challenges and opportunities in this area were discussed in the webinar. The webinar covered these topics: “Judicial consideration of digital evidence”, “Including key factors examined by courts in trademark cases”, “Admissibility standards for digital evidence in trademark disputes”, “Illustrative cases where digital evidence, such as social media posts and network”, timestamp, and blockchain data, has been considered by courts in adjudicating trademark disputes”, and “Specific challenges for judges in adjudicating trademark cases involving digital evidence”.
It has been noted that the verification and reliability of digital evidence depends on how it is collected, protected, and authenticated properly. The quality and reliability of the evidence presented in the trademark dispute resolution process significantly affects the outcome of the decision. The growing role of digital evidence is forcing legal systems and courts to create new standards for the admissibility of such evidence were emphasized in the webinar. While there are advantages to digital evidence regarding its reliability and accuracy, there are also challenges. For example, it was noted that courts are required to assess the authenticity of social media posts or whether screenshots of websites are presented with the correct date and time.
