The Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention entered into force
The Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention of September 9, 1994 entered into force on March 17, 2021.
“The Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention” was adopted at Diplomatic Conference held in Nur-Sultan, the capital of Kazakhstan, 9 September, 2019. Our country was represented at the international event by a delegation led by Chairman of Board of the Intellectual Property Agency Kamran Imanov. The protocol was signed by K. Imanov on behalf of the Government of the Republic of Azerbaijan. The depositary of the Protocol is the Director General of the World Intellectual Property Organization (WIPO).
On 5 May, 2020 the Law of the Republic of Azerbaijan “on affirmation of the Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention” was adopted.
On December 9, 2020, at the WIPO headquarters in Geneva, the Permanent Representative of the Republic of Azerbaijan to the UN Office in Geneva and other international organizations, Ambassador Extraordinary and Plenipotentiary Vagif Sadigov presented the document on approval of the “Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention of September 9, 1994” to WIPO Director General Daren Tang.
The "Protocol to the Eurasian Patent Convention on the Protection of Industrial Designs" was adopted on the basis of a single Eurasian patent for an industrial design to protect an industrial design in the territory of 8 EAPO member states. The protocol envisages the expansion of the Eurasian system of protection of industrial property, the establishment of an interstate system for the protection of industrial designs on the basis of a single Eurasian patent in force in all signatory states, the development of their domestic markets, as well as increasing the attractiveness of their territories for trade and investment..
