The works of the famous Azerbaijani composer Eldar Mansurov were misappropriated by the Armenians

In addition to Azerbaijani folklore expressions, the fact that songs of Azerbaijani composers were misappropriated by Armenian performers became widespread. Thus, People's Artist of Azerbaijan, Honored Worker of Art, Composer Eldar Mansurov applied to the Intellectual Property Agency, stating that his works - “Bayatılar”, “O gələndə” , “Bir payız gecəsi” , “Yarı səndə, yarı məndə” və “Gecələr keçir” were misappropriated by Armenian performers, and asked for help in restoring the infringed copyrights.

As a result of a relevant investigation conducted by the Intellectual Property Agency, it was established that “Bayatılar” by Eldar Mansurov was performed by Armenian singers Mikhail Mirzabekov and Alexander Shakhunts and posted on the YouTube channel (https://www.youtube.com/watch?v=eRzCwpVBH7M). The performed musical works coincide with the music of the Azerbaijani composer Eldar Mansurov "Bayatılar". This means that the title of Eldar Mansurov's work "Bayatılar" has been changed and distorted, and at the same time his name is not indicated as the author of the work. Thus, the moral and economic rights of Eldar Mansurov were infringed. The music of the song “Bayatılar”, the words of which belong to the national poet Vahid Aziz, was written by Eldar Mansurov in 1988. The lyrics of the song were published in Wahid Aziz's book "Əllərimin kölgəsi" in 1985. The song was first performed in 1989 by the singer Brilliant Dadasheva, later the song was performed in many languages of the world and by performers from different countries under different names with the consent of Eldar Mansurov (for example, the Ashgabat group from Turkmenistan - "Bayatılar" (1990), the Russian singer Reno Migranov - "Здравствуй" (1990), the Turkish singer Sezen Aksu - "Zalim" (1995), the Greek singer Petros Durdumpakis - "Taxidiariko Pouli" (1995)). Although the mentioned performers changed the title and lyrics of the song, they indicated the name of Eldar Mansurov as the author of the music.

In Azerbaijan, this song was performed by singers Ilgar Muradov (in 1989) and Faig Aghayev (in 1996), violinists Natig Nuriyev (in 1989) and Kazbek Aliyev (in 1995). In 1991, with the support of the Ministry of Culture of the former USSR, it was included in the album "Bayatı", released by the recording studio "Firma Melodiya".

The work “Bayatılar” was registered (certificate No. 3048) with the Copyright Agency of the Republic of Azerbaijan (current Intellectual Property Agency) based on the application of Eldar Mansurov dated February 24, 2006 and entered in the state register.

Another famous song "Yarı səndə, yarı məndə", whose lyrics belong to Nusrat Kasamanly, was attributed to Armenian singers. For example, the Armenian clarinetist Yegishe Gasparian posted the song "Yarı səndə, yarı məndə" on clarinet under the name "Mtamolor" and provided information about the author.

The song "Yarı səndə, yarı məndə" performed by Aghadadash Agayev is included in Eldar Mansurov's album "Yenə görüşərik", released by the recording studio "Bakı&Raks" in 1998.

The song "Yarı səndə, yarı məndə" was registered in 2006 (certificate No. 3069) at the Copyright Agency of the Republic of Azerbaijan (current Intellectual Property Agency) based on the application of Eldar Mansurov and entered into the state register.

The song “Gecələr keçir” by the composer Eldar Mansurov, owned by the national poet Vahid Aziz, was performed by the Armenian singer Karen Gevorgyan, sounded on the radio and downloaded in mp3 format on various Internet resources (https://music.radio.lol/track/943425-karen-gevorgyan-siro-partez).

Aygun Kazımova performs the song "Gecələr keçir" for the first time. In 2000, this performance was included in the music album "Gecələr keçir" by the recording studio "Shahin-R".

The song was entered into the state register by certificate No. 3060, registered with the Copyright Agency of the Republic of Azerbaijan (the current Intellectual Property Agency).

The facts of violation of the copyright of composer Eldar Mansurov by Armenian performers were investigated and analyzed by the musical expert of the Intellectual Property Agency, People's Artist of Azerbaijan, composer Faig Sujaddinov, and thus it was established that the songs posted on the YouTube channel performed by Armenians exactly match with musical works of Azerbaijani composer Eldar Mansurov.

The presentation of the above-mentioned songs of the Azerbaijani composer Eldar Mansurov as Armenian songs means an infringement by the Armenians of the provisions of the Berne Convention for the Protection of Literary and Artistic Works, the WIPO Copyright Treaty and the WIPO Performance and Phonograms Treaty, to which Azerbaijan and Armenia are parties.

With the request to eliminate the above-mentioned infringements of rights, to indicate that the songs posted on the YouTube channel belong to Eldar Mansurov, otherwise, the Administration of that channel will be requested to remove them from YouTube.
